Title

A Resolution of the City Council of the City of Pflugerville, Texas, declaring the public purpose and necessity to acquire an approximate 0.0649-acre (2,825 sf) right of way easement and an approximate 0.1189-acre (5,179 sf) public utility easement; each located in the Nathan Moore Survey No. 45, Abstract 512; and generally located adjacent to Boulder Drive and between its intersection with Canyon Drive and Rocky Creek; in the City of Pflugerville, Travis County, Texas; the acquisitions being required to support the City’s construction of the Boulder Ridge Lift Station Rehabilitation and Expansion and Force Main Project; and authorizing the City Attorney to proceed with activities necessary to acquire said properties, including institution of condemnation proceedings to acquire the necessary land rights through the use of the City’s eminent domain authority.

Summary

This resolution has been included on the agenda to follow for discussion and potential action regarding a right-of-way easement and public utility easement (Parcel 1) needed for the Boulder Ridge Lift Station Rehabilitation and Expansion and 8-Inch Force Main WW2403; with an appraised amount of $14,642. The City has determined a public need to acquire the right-of-way and public utility easement for the purpose of expanding and rehabilitating the Boulder Ridge Lift Station from a firm capacity of .33 MGD to .6 MGD and installing a permanent power generator. The need for an 8-Inch force main conveying wastewater from the Boulder Ridge Lift Station along Boulder Drive (private drive) to an existing manhole at the west terminus south of Gilleland Creek was discovered during preliminary engineering of the lift station.

Unfortunately, the property owners have not been agreeable to the offer and/or the terms outlined in the right-of-way and public utility easement proposals. Staff and the City’s land acquisition consultant, 7 Arrows Land Staff LLC., have conducted discussions with the property owners regarding the right-of-way and public utility easement terms. At this time, it is necessary to initiate condemnation proceedings to advance the acquisition process and allow the project to move forward.

Approval of this resolution authorizes the City Manager and the City Attorney, on behalf of the City, to initiate condemnation proceedings and take all actions necessary to acquire the property through the exercise of eminent domain.
