Title
Authorizing the City Manager to execute the Amended and Restated Water Utility Access Easement Agreement with Waste Management of Texas, Inc. to allow the installation of two (2) gas vents within the City of Pflugerville's forty (40) ft. waterline easement, which contains a 30-inch water main.
Summary
The City of Pflugerville executed a Water Utility and Access Easement Agreement with Waste Management of Texas, Inc. (WMTX) for the raw water line from the Colorado River to Lake Pflugerville in 2003.  WMTX has requested written authorization from the City of Pflugerville to install two (2) new utility trench gas vents just west of the Austin Community Recycling and Disposal Facility (ACRDF) in that easement.  According to the approved MSW Permit No. 249D, "These utility trenches will be vented and monitored regularly. Monitoring gas probes or atmospheric vents will be placed in the porous media around the pipe systems where the utility trenches leave the property.  Monitoring will be done quarterly along with other perimeter probe monitoring. Results will be documented and placed in the site operating record."  Pursuant to 30 TAC §330.371(f), the pipeline trenches will be vented and monitored regularly at each location where the utility trenches cross the facility boundary.
 
Attached is the proposed Amended and Restated A Water Utility and Access Easement Agreement, including the addition of a new section titled "UTILITY TRENCH GAS VENTS" on page 4 and a corresponding attachment for reference to Exhibits "A", "B" and "C." These plans have been reviewed and WMTX will coordinate the construction of these vents with city staff, assuring compliance with regulatory standards. The agreement has also been reviewed and approved as to form by the City Attorney.
 
Prior City Council Action
If approved, the proposed agreement will supercede the original agreement dated December 15, 2003 recorded and filed with Travis County as document # 2004054660 as set forth in the Water Utility And Access Easement.
 
Deadline for City Council Action
Staff is requesting approval on May 8, 2012 to support Waste Management of Texas, Inc. efforts to maintain their project schedule.

Staff Recommendation
Staff recommends City Council authorize the City Manager to execute the agreement.
