FOR THE COLLECTION OF REFUSE FOR MULTI-FAMILY, COMMERCIAL AND INDUSTRIAL ESTABLISHMENTS; PROVIDING THE TERMS AND CONDITIONS OF THE FRANCHISE GRANT; ESTABLISHING A TERM OF THE FRANCHISE; AND PROVIDING AN EFFECTIVE DATE.

 

Summary

The City of Pflugerville entered into franchise agreements for commercial solid waste collection five years ago.  The terms of these agreements will expire in January and February of 2012 so staff has prepared documents to extend the franchises for five years.  These franchises were developed to compensate the city for the use of the rights-of-way and provide a method for the city to monitor companies working within the City of Pflugerville.  Insurance limits are specified and contact information for each company is provided to staff.  In addition, staff recommends adding Section 3G to the ordinance requesting information regarding existing or planned implementation of commercial recycling. 

 

The franchise fee of 6% of gross revenues is commensurate with that charged by other cities in our area.  The city attorney has reviewed the ordinance.

 

Prior City Council Action

Commercial solid waste franchises were approved five years ago with the five companies that are reapplying at this time. No other companies provide commercial solid waste within the City of Pflugerville.  This ordinance was approved on first reading at the November 22, 2011 City Council meeting, and approved on second reading at the December 13, 2011 City Council meeting.

 

Deadline for City Council Action

Staff recommends approval on third reading at this meeting because three of the five franchises expire in January, when the third reading would complete the process. Due to paperwork issues five years ago, the other two franchise agreements were not approved until the following month.  Staff is recommending the same five year term for all five franchisees. The city charter requires three readings for any ordinance granting a franchise.

 

Fiscal Impact

The total revenue from this source in calendar year 2010 was $58,768.95.  Central Texas Refuse paid a total of $7,501.55.

 

Staff Recommendation

Approve the ordinance on third reading.
