Summary
The City of Pflugerville approached Cebridge Acquisition L.P. (Suddenlink Communications) for acquisition of a 15-ft drainage easement necessary to mitigate drainage issues located on Walter Avenue. The residence at 579 Geyser Avenue experiences public flows routing through the property during every rain occurrence. 579 Geyser Avenue does not contain a drainage easement and periodically the structure is inundated with flows during large rain events.
The subdivision was final platted in 1996. As part of the final plat, right of way was dedicated to route flows from Walter Avenue north to Noton Avenue via the future Wren Avenue right of way. In 1998, City Council approved the release and vacation of a portion of the Wren Avenue right of way (ORD 498-98-05-12). With the vacation of the right of way, there is no way to route drainage in accordance with the subdivision plan.
City staff developed an alternative to route the drainage to existing storm infrastructure and mitigate flows impacting 579 Geyser Avenue. In order to implement this alternative, a drainage easement was needed from the Suddenlink property. City crews shall construction an earthen swale and make improvements to Walter Avenue to route flows from the street, through the drainage easement to an existing area inlet where flow is then incorporated into the storm drain system.
The City Attorney and Staff have reviewed and approved the Cebridge Acquisition/Suddenlink Communications drainage easement language.
