Title
Discuss and consider action to approve a resolution of the City Council of the City of Pflugerville. Texas, directing the City Manager or the City Manager’s designee to execute all documents to institute eminent domain proceedings for the acquisition of land situated for right-of-way and grading easement in Pflugerville, Travis County, Texas and directing the City Attorney to initiate condemnation proceedings associated with the East Pflugerville Parkway (Colorado Sand to Weiss) Project.

Summary
This resolution has been included on the agenda to follow for discussion and potential action regarding right-of-way and grading easements (Parcels 3/3E) needed for the East Pflugerville Parkway (Colorado Sand to Weiss) Project. The City has determined a public need to acquire right-of-way and grading easement for the purpose of widening the roadway to a four-lane urban section including new traffic signals, lighting, a shared-use path, and improvements to utilities and drainage infrastructure. This project was identified for design in the 2020 General Obligation Bond Program, construction is being funded by the 2025 certificate of Obligation Bond.

Although offer was discussed and agreed upon, no binding agreements were ever executed, and the transaction did not proceed. City legal counsel and City’s land acquisition consultant, Lockwood, Andrews & Newman, Inc have conducted discussions with the property owner regarding the right-of-way and grading easement terms. At this time, it is necessary to initiate condemnation proceedings to advance the acquisition process and allow the project to move forward.

Approval of this resolution authorizes the City Manager and City Attorney, on behalf of the City, to initiate condemnation proceeding and take all actions necessary to acquire the property through the exercise of eminent domain.

This project supports the Mobility Infrastructure and Connectivity Pillar of the Strategic Plan.
