Approving and authorizing the City Manager to execute Amendment No. 1 to Professional Services Agreement between Kelly Lane Water Control and Improvement District (WCID) No. 1 (Avalon) and the City of Pflugerville concerning the operation, maintenance and management of water and wastewater facilities and municipal solid waste services within Kelly Lane WCID No. 1 related to the collection of wastewater impact fees and concurrence with the district's stormwater management program.

Summary
The Professional Services Agreement Between Kelly Lane WCID No. 1 and the City, dated June 28, 2007, includes a the provision to establish the timing for payment of capital recovery fees, also known as impact fees, to be collected by the City at the time of final plat approval. The city only collects wastewater impact fees in Avalon. The amendment revises the timing for impact fees to be collected prior to issuance of a building permit. The revised timing for impact fee payment is consistent with the City Code of Ordinances for projects located in City limits. This item is related to the North Pflugerville Wastewater Interceptor System (NPWIS) Construction and Participation amendment on this agenda, agenda item 2015-4238. In addition, through this amendment the City acknowledges that it is aware of the District's stormwater management program, and will conduct all services under the agreement in compliance with the MS4 Obligations and in a manner that does not introduce any illicit discharges (as defined in the MS4 General Permit) of pollutants to streets, stormwater inlets, drainage ditches, or any portion of the District's drainage system.

This is needed because the District was issued a Small Municipal Separate Storm Sewer System (MS4) Permit last year, and one of the requirements under the new MS4 general permit relates to contractor requirements and oversight.
