Summary
Chapter 43, Subchapter C-3 of the Texas Local Government Code authorizes municipalities to annex property on the request of all property owners in an area. Pursuant to Texas Local Government Code Section 43.0672, the City entered into a written agreement with the owners of land in the area for the provision of City services on October 23, 2020.
The proposed annexation consists of approximately 33.0 acres located south of E. Pecan Street and west of SH 130 within the City's extraterritorial jurisdiction. The subject property is contiguous to properties within the City limits and therefore is eligible for voluntary annexation in accordance with state law. The area is unimproved and therefore does not incur maintenance/operations expenses. On November 12, 2020, the subject property was deannexed from the Northeast Growth Corridor Water, Sewer, Irrigation, and Drainage District No. 2, a special district created by State legislation in 1989.

On December 1, 2020, the agent working on behalf of RNDC and Hagn & Timmerman LTD requested a postponement of the 2nd reading of the annexation ordinance originally scheduled for the December 8, 2020 City Council meeting. RNDC subsequently requested to move forward...
