Summary
This item considers approval of a License Agreement with Jason Henderson d/b/a Pflugfun for the continued operation of the non-motorized watercraft rental concession at Lake Pflugerville.
Pflugfun provides kayak, canoe, paddleboard, and other non-motorized watercraft rentals from the Lake Pflugerville Boathouse, located on the northeast side of the lake near the boat ramp. The agreement also allows for the sale of prepackaged consumable foods as a non-exclusive concession service.
The proposed agreement establishes an exclusive license for non-motorized watercraft rentals and a non-exclusive license for concession sales, while maintaining year-round operations with required seasonal staffing and minimum operating hours. The initial term will run from May 13, 2026 through December 31, 2026, with two additional one-year renewal terms through December 31, 2028.
The updated agreement strengthens operational and safety requirements by requiring full compliance with the Texas Water Safety Act, mandatory use of U.S. Coast Guard approved personal flotation devices, staff training and customer safety orientation, weather and emergency operations protocols, and immediate termination rights for safety violations or unlawful use.
Under the agreement, Pflugfun will pay the City either a monthly license fee or 5% of gross revenues, whichever is greater, with seasonal fee structures based on operating periods throughout the year. The licensee remains responsible for all staffing, equipment, insurance, maintenance, and daily operational oversight
This agreement ensures continued recreational access and activation at Lake Pflugerville while maintaining strong operational and safety standards for public use.
