Adopting a resolution approving the Land Use Assumptions and Capital Improvements Plan Amendments for the Impact Fee Study conducted by Lockwood, Andrews, and Newnam, Inc. (LAN).
 
Summary
The City of Pflugerville utilizes water and wastewater impact fees to insure that new development assumes a portion of the cost of growth and development within the utility system.  Chapter 395 of the Texas Local Government Code establishes the framework for the establishment of impact fees. Sec. 395.047 requires the City to update the land use assumptions and capital improvements plan (CIP) at least every five years.  
 
City staff has worked with LAN to revise the current impact fees based on the proposed updates to land use assumptions and CIP.
 
Status
Staff presented the land use assumptions and CIP for proposed water and wastewater impact fees in a public hearing before the City Council as required the Texas Local Government Code on March 25, 2014.  This resolution provides for adoption of the land use assumptions and capital improvements plan amendments included in the study.
 
Deadline for City Council Action
Action is requested at this meeting to keep the schedule on track for adoption of new impact fees to be effective July 1, 2014.
 
Projected Future City Council Action
If approved at the April 8th Council meeting, a public hearing will be held on May 27, 2014 to review proposed impact fees.  The first reading of an updated impact fee ordinance will be presented to Council on May 27, 2014 for adoption with a second reading at the subsequent meeting on June 10, 2014.
 
Fiscal Impact
The City will realize a net positive fiscal impact if the ordinance is adopted.  
 
Staff Recommendation
Staff recommends approval of the resolution adopting the land use assumptions and capital improvements amendments associated with revisions to Pflugerville's water and wastewater impact fees.
