Approving and authorizing the City Manager to execute a Third Amendment to NPWIS Construction and Participation Agreement associated with the payment of wastewater impact fees for the Avalon Subdivision.
Summary
The North Pflugerville Wastewater Interceptor System (NPWIS) Construction and Participation Agreement was originally approved in 2004 and established the timing for payment of wastewater impact fees to be collected by the City at the time of final plat approval. The proposed Third Amendment revises the timing for impact fees to be collected prior to issuance of a building permit. The revised timing for impact fee payment is consistent with the City Code of Ordinances for projects located in City limits.
Status
The Avalon Subdivision lies within Kelly Lane Water Control and Improvement District (WCID) #1 and #2. The original consent agreement is dated August 30, 2004, the first amendment is dated May 10, 2006, and the second amendment is dated February 12, 2013. A total of 1424 single-family residential lots are planned and 525 houses have been completed as of September 1, 2015.
