Title

Approving a resolution adopting a Multiple Use Agreement with the Texas Department of Transportation (TxDOT) affiliated with the FM 1825 trail gap improvements.

Summary

As part of the 2014 GO Bond for trail gap improvements, one proposed section was along FM 1825 from Meadow Lane to Swenson Farms.  The proposed pedestrian improvements are situated within TxDOT right of way.  The improvements include the construction of a sidewalk and associated ramps to improve safety and connectivity.

TxDOT requires the execution of a Multiple Use Agreement (MUA) for any new facilities proposed within TxDOT right of way.  Subsequently, it is a requirement of the MUA that the City Council pass a resolution adopting the MUA for the associated improvements.  The MUA addresses ownership and maintenance responsibilities for the proposed improvements within TxDOT right of way.

Per TxDOT's requirements, following City Council approval of the resolution authorizing the MUA, City staff will forward the approved resolution and project plans to TxDOT. TxDOT will then complete the MUA template which is attached to the item.

With the execution of the MUA and construction of the improvements, the City of Pflugerville will be fiscally responsible for maintenance and operation of the proposed pedestrian improvements along the north side of FM1825 from Meadow Lane to Swenson Farms.  The proposed improvements are expected to be completed in summer 2016.

The City Attorney has reviewed the MUA.
