Summary
The Texas Human Resources Code Section 42.041 (b) (14) provides an exemption to childcare licensure requirements for an elementary-age recreation program operated by a municipality provided that the governing body of the municipality annually adopts standards of care by ordinance after a public hearing for the program.  This ordinance has been provided to establish these standards of care in order to exempt Pflugerville Parks and Recreation programs from state child care licensing requirements. These standards of care are intended to be minimum standards by which the City will operate its Parks and Recreation Department summer camp and other programs.  Pflugerville Parks and Recreation programs are recreational in nature and are not child care programs.

This ordinance was approved as written by the City Council in the spring of 2013.  Staff is not recommending any changes to it at this time.

A public hearing and re-approval of the ordinance is required each year.  The required public hearing for this year and the first reading of the ordinance was done on April 22, 2014.

Projected Future City Council Action
The ordinance is required to be adopted each year after a public hearing is held.

Staff Recommendation
Approve the ordinance on second and final reading.
