Authorizing the City Manager to enter into a standard form Water Line Easement Agreement and Wastewater Easement Agreement from Mr. Terrell Timmermann necessary for the extension of utilities to serve the Lot 1, Block A of the Bohls Commercial Park Subdivision, also known as the Hawaiian Falls Water Park.
Summary
Off-site improvements are necessary to serve the water park site with public water and wastewater. This easement is needed due to constraints along the east side of utility connections. The infrastructure improvements are related to the platting of Lot 1, Block A of the Bohls Commercial Park Subdivision, which is the location of the Hawaiian Falls Water Park, currently under construction. Although the limits of the easement have not been determined because this information will be provided by the consultant for Hawaiian Falls, staff has a general idea of the approximate size and location.

Fiscal Impact
The City will be responsible for the operation and maintenance of the constructed water and wastewater improvements within this easement.
