Summary
Per the "Stormwater Acceptance, Roadway Dedication, Release and Settlement Agreement" between A-S 93 SH 130-SH 45, L.P. (NewQuest), Terrell Timmermann, and the City of Pflugerville, a Right-of-Way (R-O-W) easement for the north-south collector roadway was required to be dedicated to the City and a Special Warranty Deed was required to be executed to allow for a future roadway between Stone Hill and the Timmermann tract adjacent to Home Depot. The R-O-W easement will remain valid until a final plat for Stone Hill Town Center, Section Two has been approved and recorded with Travis County. The easement and deed are further described in the attachments.
Status
The City has received executed copies of the R-O-W Easement and Special Warranty Deed on behalf of A-S 93 SH 130-SH 45, L.P. and these have been reviewed by the City Attorney.
Prior City Council Action
The City of Pflugerville approved the "Stormwater Acceptance, Roadway Dedication, Release and Settlement Agreement" between A-S 93 SH 130-SH 45, L.P. (NewQuest), Terrell Timmermann, and the City of Pflugerville in August of 2011.
