Summary
This resolution is for authorization of the City Manager to execute a Vacation, Abandonment and Release of Easement to vacate an existing public utility easement within the 685 Commercial Park Subdivision. Vacating this easement will allow for the property to be utilized for future site development improvements. This public utility easement was granted to the City with the 685 Commercial Park final plat and has not been utilized by the City or other public utility companies since its creation. City staff has confirmed with all franchised public utility providers that the property is not needed for public utility purposes and that it is in the public interest to vacate, abandon and release the public utility easement. The City Attorney has reviewed and approved the resolution and vacation instrument as to form.
