Title

Approving an Assignment and Consent of the City of Pflugerville, Texas to the Assumption of the New Sweden Development Agreement, and authorizing the execution of a Memorandum of Agreement.

 

Summary

The New Sweden Development Agreement applies to New Sweden Municipal Utility Districts 1, 2, and 3 that are generally situated along both sides of FM 973 in the far eastern portion of the City's extraterritorial jurisdiction (ETJ). New Sweden MUD 2 consists of 426.0 acres along both sides of FM 973. The western portion of New Sweden MUD 2 consists of 309.5 acres that is located west of FM 973 and is the subject tract that has changed hands, from (Joe) Owen NS2, L.P. to Rowe Lane Development, Ltd (Rob Tiemann). Section 4.4 of the Assignment and Consent of the City of Pflugerville, Texas to the Assumption of the New Sweden Development Agreement (attachment to this agenda item)  specifies the terms of this assignment which shall not unreasonably be withheld. The Memorandum of Agreement shall be filed with the Travis County Clerk.

 

Both documents have been reviewed and approved as to form by the City Attorney.

 

Status

There is currently no development activity associated with any of the districts.

 

Prior City Council Action

The development agreement was effective March 14, 2007.

 

Fiscal Impact

There is no direct impact associated with the approval of this item.

 

Staff Recommendation

Staff recommends approval of the assignment of the agreement.
