Summary
The City of Pflugerville has a franchise ordinance in effect with Oncor that was originally approved in 1988 for a 25 year term. The franchise establishes parameters for Oncor's use of the city's rights-of-way and the amount and timing of Oncor's franchise fees to the City. The term of this franchise agreement is twenty years. The charter requires that all franchise ordinances be read three times. Through Mr. Eddie Ferguson, the Area Manager for Oncor Electric Delivery, the City has had a good working relationship with Oncor.

This ordinance was approved on first reading on March 12, 2013 and second reading on March 26, 2013.

Prior City Council Action
The current ordinance was approved on April 9, 1988, for a term of 25 years. Two amendments to the ordinance were made in 1993 and 2003 to reflect changes in state law and company identification.

Deadline for City Council Action
The current 25 year agreement expires on April 26, 2013.

Fiscal Impact
The calculation of franchise payments described in the new ordinance is identical to the existing ordinance. The amount received in fiscal year 2012 equaled $1,122,041. This amount will increase yearly as new development increases the amount ...
