Title
Discuss and consider action to approve a resolution of the City Council of the City of Pflugerville. Texas, directing the City Manager or the City Manager’s designee to execute all documents to institute eminent domain proceedings for the acquisition of wastewater easement and temporary construction easements in Pflugerville, Travis County, Texas and directing the City Attorney to initiate condemnation proceedings associated with the 15 Inch Northwest Wilbarger Line Extension Project.

Summary
This resolution has been included on the agenda to follow for discussion and potential action regarding the wastewater easement and temporary construction easements on Parcel 1 needed for the 15 Inch Northwest Wilbarger Line Extension Project. As part of the project, it is necessary for the City to acquire the wastewater easement and temporary construction easements for the purpose of constructing the project. As of now the City has successfully secured two temporary construction easements and 2 wastewater easements with four easements still pending. The wastewater line extension totaling approximately 1,900 LF from an existing connection located on the west side of SH 45 and SH 130 to provide service to the area northwest of the highway interchange on SH 130 and SH 45 in the Wilbarger Drainage Basin, as identified in the City’s 2023 Wastewater Master Plan Update.

Unfortunately, the property owner has not been agreeable to the offer and/or the terms outlined in the easement proposals. City staff have conducted discussions with the property owner and attorneys regarding the wastewater easement and temporary construction easements terms. At this time, it is necessary to initiate condemnation proceedings to advance the acquisition process and allow the project to move forward.
