Summary
The proposed agenda item requests approval of a conditional purchase agreement and associated conveyance documents between Fuchs Grove, LLC and the City of Pflugerville as necessary to acquire real property interests for the Wilbarger Creek Wastewater Interceptor Project. The Wilbarger Creek Wastewater Interceptor will convey flows from the existing Carmel and Weiss Lane Lift Stations to the new Wilbarger Creek Regional Wastewater Treatment Facility. This item supports the infrastructure pillar of the Strategic Plan.
This conditional purchase agreement with Fuchs Grove, LLC. conveys the acquisition of a permanent easement necessary to construct the project. While this parcel was identified for eminent domain, staff continued negotiations which resulted in a resolution with the property owner for a settled amount of $470,000.00. This not only eliminated the need for the eminent domain process but also averted all associated additional costs. This parcel is the last outstanding easement necessary for the project, the project is anticipated to bid later this month.
Approval of this item will authorize the City Manager to execute the utility easement, and associated conveyance documents necessary for formal conveyance of the real property interests.
