Approving a resolution to extend the 60-day period required for City Council to conduct a public hearing for a proposed rezoning case.
 
Summary
On July 1, 2013, the Planning and Zoning Commission conducted a public hearing and considered an application to rezone two separate tracts located along the east side of FM 685, generally southeast of the Steeds Crossing and FM 685 intersection, from Corridor Urban Level 4 (CL4) and Agriculture/Conservation (A) to General Business 2 (GB2) for a proposed U-Haul self storage and vehicle rental business at the former All Ways Storage facility. While considering the request, the Commission expressed concerns pertaining to screening and storage of U-Haul vehicles and timing for future improvements.
 
The Commission recommended approval of the rezoning application.  Following the meeting, however, the applicant asked to delay the City Council public hearing and consideration to allow for review of the Commission's concerns. According to Subchapter 3(B)(4)(e) of the Unified Development Code, within 60 days of the initial public hearing held by the Commission, the City Council must either approve, deny or extend the 60-day period for a maximum of an additional 30 days.  Otherwise per Subchapter 3(B)(4)(f), the request is deemed denied. The applicant has informed staff that they are ready to address this matter with the Council and have requested the necessary extension so they may be considered on the next available City Council meeting.
 
Projected Future Action
If the resolution is approved, the City Council will hold a public hearing for the rezoning request and consider first reading of the ordinance on September 10, 2013.
