Title
Approving an ordinance on second reading with the caption reading: AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF PFLUGERVILLE, TEXAS, AMENDING CHAPTER 110, (ENTITLED “FOOD ESTABLISHMENTS”) OF THE CITY OF PFLUGERVILLE’S CODE OF MUNICIPAL ORDINANCES BY DESIGNATING THE CITY OF PFLUGERVILLE TO BE THE REGULATORY AGENCY ADMINISTERING THE CHAPTER; PROVIDING A CUMULATIVE CLAUSE; PROVIDING FOR SEVERABILITY; PROVIDING FOR PROPER NOTICE AND MEETING; AND PROVIDING FOR AN EFFECTIVE DATE.
Summary
The purpose of this proposed ordinance is to change the responsible party for health inspections in the City from Williamson County and Cities Health District to the City of Pflugerville, and conform to the State of Texas model code. This shift was requested by Williamson County as their new operations model precludes contracting with entities not in Williamson County. Staff has investigated various options for inspections, which must be performed by a Registered Sanitarian, including the Austin/Travis County Health Department; city staff; or contracted services. At this time, staff is discussing expanding the scope of services currently provided by Bureau Veritas who is already doing commercial building plan review for the City of Pflugerville. The administration of this program will be through the Development Services Center with the primary point of contact being Mr. Blake Overmyer. Upon approval of this ordinance on first reading, staff will notify all affected parties of the change.

This proposed ordinance has been reviewed by the City Attorney and approved as to form.

Status
The City of Pflugerville was notified earlier this year by Williamson County Health District that the District would no longer perform food establishment inspections as of January 1, 2013.
