Title
Approving a resolution adopting a Multiple Use Agreement (MUA) with the Texas Department of Transportation (TxDOT) for the FM685 and SH130 sidewalk improvements.  
 
Summary
The development of the Hawaiian Falls Waterpark requires that sidewalks be constructed along the SH130 and FM685 frontage roads adjacent to the park. In addition, a challenge grant was approved by the Pflugerville Community Development Corporation (PCDC) for construction of the sidewalks from the northern property line of the waterpark along SH130 to the intersection of SH130 and FM685.  The proposed pedestrian improvements are located within TxDOT right-of-way.  The improvements include the construction of a sidewalk and associated improvements to provide pedestrian access along these corridors.
 
TxDOT requires the execution of a Multiple Use Agreement (MUA) for any new facilities proposed within TxDOT right of way. It is a requirement of the MUA that the City Council pass a resolution adopting the MUA for the associated improvements.  The MUA addresses ownership and maintenance responsibilities for the proposed improvements within TxDOT right of way.  The additional exhibits (Exhibits, C, D and E) regarding TXDOT approval of the construction plans, which will coincide with the plans approved by the City, Certificate of Insurance and Federal Highway Administration attachment will be added to the document once TXDOT receives the resolution approving the MUA and prior to final execution by the City or TXDOT.  The City Attorney as reviewed the MUA.
 
With the execution of the MUA and construction of the improvements, the City of Pflugerville will be fiscally responsible for maintenance and operation of the proposed pedestrian improvements when the construction is accepted.  The proposed improvements are expected to be completed in July 2014.
