Summary
The Planning Department has been made aware of issues with existing storage sheds less than 200 square feet not meeting the minimum 5-foot setback as required in Subchapter 4 of the Unified Development Code. Currently storage sheds are addressed as an “Accessory Building Other than Unattached Garage” and are required to maintain a minimum setback of five feet from rear and side-interior property lines. Storage sheds that are less than 200 square feet however do not require a building permit and therefore a homeowner placing this type of structure may not be aware of the 5-foot setback requirement.

Recently, the Board of Adjustment approved a special exception for such a request in the Highland Park North neighborhood and concern has been made that this may not be an uncommon condition throughout the City. In order to proactively reduce the number of potential nonconformities, the Planning Department recommends reducing the setback requirement from 5-feet to 2-feet. Provided no additional constraints existed (i.e. easements), the proposed setback would allow for maintenance on the structure and nearby fences, while enabling the homeowner to have more useable space within their property.

Deadline for City Council Action
On October 26, 2010 the City Council conducted a Public Hearing and received no public comment. Following the Public Hearing, the Council approved the Ordinance on First Reading.
