Discuss and consider action to approve a professional services supplemental agreement with Freese and Nichols, Inc. to amend the original agreement’s scope of services and fee to add an additional amount of $77,166 for emergency repairs at the Lake Pflugerville Pump Station and authorizing the City Manager to execute the agreement.

Summary
A professional services agreement with Freese and Nichols, Inc. was approved at the May 13, 2014 City Council meeting in the amount of $62,178 to assist with emergency repair design for the Lake Pflugerville Pump Station. The original scope of the project included a thorough investigation of the causes of the corrosion failure of the existing pump cans, development of design and specifications for the replacement pump cans, assistance for the City in procuring the replacement pump cans and a contractor for the installation, and availability during construction to assist in resolving any technical issues. This supplemental agreement provides for additional items that have been added to the original scope of services of the project as requested by City staff including the following: on-site support and testing during construction and accommodation of an extended construction schedule.

Although the original agreement described the anticipated bid and construction phases of this project, there was no allocation of cost included for them. The amount of $77,166 will be used for these phases as described in detail on the attached supplemental agreement.
The attached agreement has been reviewed and approved as to form by the City Attorney.

Deadline for City Council Action
Approval is necessary for staff to move forward with repairs.

Fiscal Impact
The costs of this emergency situation will be funded through utility fund balance and included in the proposed budget amendments for the third quarter of fiscal year 2014.
