Title
Approving a Project Grant Agreement (PGA) with Capital Metro regarding the use of 5307 funds for the Pflugerville Transit Development Program (TDP).

Summary
Initially, the mechanism to secure the 5307 funds from Capital Metro was via an interlocal agreement. At the request of Capital Metro, this Project Grant Agreement is preferred. The PGA provides that the City of Pflugerville is the subrecipient of the grant funds and shall be responsible for the transit development plan in compliance with the requirements of the revised Capital Metro Service Expansion Policy adopted in 2014. The grant term is through December 31, 2015, sufficient time to complete the project, which is estimated to take nine months. The maximum grant payable under the PGA is $103,200. The funds are subject to a Single Audit Report as required based on the total federal funds utilized by the City in a fiscal year.

During the November 25, 2014 City Council meeting the city manager was authorized to enter into a contract with The Goodman Corporation for the preparation of a TDP. That action is contingent upon the approval of this PGA by Capital Metro and receiving written approval and consent to the subcontractor, The Goodman Corporation, from Capital Metro. In addition, Pflugerville will comply with all applicable Federal Transit Administration (FTA) regulations, policies, procedures and directives, as they may be amended or promulgated from time to time during the term of this PGA.

Status
The proposed PGA has been reviewed and approved by Capital Metro staff and by the City Attorney as to form.

Prior City Council Action
On November 25, 2014, the City Council authorized the Transportation Development Program project to proceed subject to this PGA.

Deadline for City Council Action
Staff is requesting approval of this item on January 13, 2015 to maintain the project schedule.
