Title
Authorizing the City Manager to execute a warranty deed, as an executory interest holder, accepting the future conveyance of real property to the City of Pflugerville, to be dedicated as public parkland, legally described as Lot 71, Block A, Sorento Phase 1 Subdivision.

Summary
In accordance with the Unified Development Code, Subchapter 14 Section B(1)(c), public parkland is required to be conveyed by a warranty deed to a public entity. The subject lot is 2.84 acres located the northside of the Sorento Subdivision just at the termination of future Bassano Avenue and is located within Travis County Municipal Utility District (MUD) No. 17. The property is south of and adjacent to the Randig Tract, currently being evaluated for park purposes. The basis of the warranty deed is the transfer of the property from the developer, Sorento Holdings 2012 to Travis County MUD No. 17, with the City of Pflugerville being the executory interest holder. The effect of the document is to establish that upon dissolution of Travis County MUD No. 17, and subsequent annexation, the ownership will automatically become that of the city. In addition, certain restrictive covenants established by the deed require the city to consent to any improvements of the land in addition to normal requirements associated with compliance with zoning, engineering and building codes, allowing for coordinated development of the property ultimately intended for ownership of the city.

The City Attorney has reviewed and approved the deed as to form.

Status
The Development Agreement applicable to Travis County MUD No. 17 provides that annexation of the MUD for full purposes may not occur until the earlier of fifteen years after the date of closing on the MUD’s first series of bonds or the completion of design and construction of 90% of the MUD water, sanitary sewer and drainage facilities and the issuance of bonds for payment of such facilities or reimbursement of moneys advanced.
