Title
Approving Subdivision Variances to allow for partial fiscal security for Falcon Pointe Section 13C (FP1407-04) and Falcon Pointe Section 14, Phase 2 (FP1407-05).
 
Summary
The developer of the Falcon Pointe subdivision is currently constructing Section 13C and Section 14, Phase 2 and has proposed to submit their final plat applications prior to having all public infrastructure accepted. Subchapter 15(Q)(4)(a) of the Unified Development Code requires 110% of the cost of the public improvements to be submitted with a final plat application if the improvements have not been already accepted. There is not currently a provision to allow posting partial fiscal security for the remaining improvements and therefore the developer has requested a subdivision variance to the requirement.
 
Staff Recommendation
In granting the variance, the City will retain assurance that the remaining public infrastructure can be installed. Staff recommends approval of the proposed Subdivision Variance.
