Approving a resolution authorizing the City Manager to execute all stormwater infrastructure maintenance and license agreements.

 

Summary

Stormwater License and Maintenance agreements are a routine requirement for all private development applications when stormwater from public streets/infrastructure would drain into a private detention pond. The attached maintenance and license agreement requires that the private developer perpetually own and maintain the pond, but allows the City access to the pond in the event it is necessary for the City to intervene in an effort to ensure health and public safety.

 

The practice for these applications is that each of them are required to go to City Council for approval. In an effort to streamline the development process and to ensure that these agreements are executed in a timely manner, staff is requesting that the City Manager be able to execute these agreements administratively so long as the agreement template, as attached, never changes.
