Summary
Meadowlark Phases 1 and 2 are constructing two phases of single-family residential housing on the east side of town along the "s" curve at Jesse Bohls Dr., east of Weiss Lane, west of Cameron Road, and north of the Carmel development. Meadowlark has an approved Development Agreement from October 2022, and a Planned Unit Development (PUD) that was approved September of 2023. The project dedicated city-owned right-of-way for local streets and for a major arterial - Pflugerville Parkway. As part of the PUD process, the approved ordinance allowed for publicly dedicated alleys even though the base code requirement in the Unified Development Code requires them to be private. The PUD requires the publicly dedicated alleys to be privately maintained, and this proposed license agreement sets the terms related to the required maintenance and the city's rights to the infrastructure. The improvements contemplated in the license agreement were originally approved through the Planned Unit Development, but are being memorialized through a license agreement since the rights-of-way were not dedicated at the time the PUD was approved. The license agreement outlines that it will be the developer's or the succeeding homeowner/property owners' association's responsibility to install, maintain, repair, and relocation (if necessary) of the improvements, including if the city needs to maintain the utilities that are located in the alleys.
