Approving a resolution authorizing the City Manager to execute a Release and Vacation Instrument to vacate a portion of an existing wastewater easement within the Highland Park residential subdivision.

Summary
This resolution is for authorization of the City Manager to execute a Release and Vacation Instrument to vacate a portion of an existing wastewater easement within the future Highland Park Phase C, Section 2 final plat. The easement was established in 2002 as part of the Highland Park North off-site improvements, providing a service line between the Highland Park North subdivision and the lift station located within the Highland Park subdivision. The portion of the easement proposed to be vacated crosses through two proposed residential lots within the Highland Park Phase C, Section 2 final plat. The proposed easement vacation and wastewater line removal will allow the residential lots to be developed and clear title concerns. The easement is proposed to be severed within Catoctin Drive and Cumberland Gap Street right of way in the Highland Park Phase C, Section 2 final plat. The existing wastewater line will be connected to planned wastewater lines within the aforementioned right of way. An interruption of service will be minor and only experienced during time of line connection. The City Attorney has reviewed and approved the abandonment instrument as to form.
