Summary
This resolution is for approval and adoption of a standard warranty bond form for use in all public infrastructure projects. It is a City requirement for the acceptance of public infrastructure to provide the City of Pflugerville a warranty bond in the amount of 35% of the total cost of the improvements for a period of 2 years (1 year for City of Pflugerville Capital Improvement Projects) to cover materials and workmanship. Previously, private contractors provided warranty bonds through a third party with a variation of terms and conditions. This form was generated to provide uniformity for public infrastructure projects and create standard terms and conditions for warranty of the improvements. The attached form was drafted by the Engineering Department and the City Attorney. Staff worked with private contractors and the Austin Contractors & Engineers Association on the development of language to be used in the standard warranty bond.
