Discuss and consider action to approve a resolution of the City Council of the City of Pflugerville. Texas, directing the City Manager or the City Manager’s designee to execute all documents to institute eminent domain proceedings for the acquisition of land situated for right of way in Pflugerville, Travis County, Texas and directing the City Attorney to initiate condemnation proceedings associated with the East Pflugerville Parkway Roadway Expansion Project.

Summary
This resolution has been included on the agenda to follow for discussion and potential action regarding right of way on Parcel 14 needed for the East Pflugerville Parkway Roadway Expansion Project. The project is the continuation of East Pflugerville Parkway from Weiss Lane to Avalar Avenue. This new segment of roadway will be one mile in length and consist of a 4-lane roadway with a raised center median and the addition of streetlights.

As part of the project, it is necessary for the City to acquire the right of way. The City has determined a public need to acquire the right of way for the purpose of constructing this project. The property owner Sorento Community, Inc., bylaws state that they would need to hold a vote to sell off part of their common area and have 67% of homes vote in favor. Due to the amount of rental homes they have with their out of state owners combined with abysmal participation in their HOA, Sorento Community, Inc believes that they can’t achieve the outcome City of Pflugerville is looking for. Initiating eminent domain proceedings is the most effective approach to secure the right-of-way.

This resolution authorizes the City Manager and the City Attorney, on behalf of the City, to initiate condemnation proceedings and such other actions are necessary to acquire the property by the exercise of the power of eminent domain proceedings.
