The property is approximately 19.86 acres and is currently subject to a Chapter 43 Non-Annexation Development Agreement executed in 2008. The site is located at the northeast corner of Weiss Lane and Wolf Pack Drive, south of the City’s water treatment plant.
The proposed project includes a minimum of two acres of commercial development, with the remainder of the property proposed for multifamily residential development. Shared detention would be provided on the residential portion of the property. If approved, the project would include a horizontal mix of commercial and residential uses, including a gas station with a convenience store, a restaurant, and multifamily residential development.
The proposed Development Agreement establishes the terms for future development prior to the annexation and zoning of the property. It would allow the property owner to retain certain property rights that would otherwise have been available had the property owner not agreed to voluntary annexation in 2008.
Summary of the Development Agreement
1. The amendment proposes to change the future land use designations adopted in the Aspire 2040 Plan for the property from “Neighborhood Retail/Office/Commercial” to “Mixed-Use Commercial” for the Commercial Tract and “Mixed-Density Neighborhood” for the Residential Tract.
The proposed designations would allow commercial development similar to what is permitted under the existing designation while providing additional housing options that are not traditional vertical mixed-use development, ranging from townhomes to garden apartments.
