Approving an ordinance on second reading with a caption reading: An Ordinance of the City of Pflugerville adopting the 2014 Engineering Design Manual and Construction Standards to include Construction Standard Details, as previously adopted by City Council by Ordinance No. 1206-15-02-24, as amended; replacing all engineering and construction standards in conflict; providing a savings clause; providing for severability; and providing an effective date.
Summary
The proposed ordinance and associated ordinance were originally adopted by Ordinance No. 1206-15-02-24, and have has been amended a few times since the original adoption. As part of House Bill 3966, 212.0021, the governing body of a municipality is required to publish notice in a newspaper of general circulation prior to adopting engineering and design standards associated with streets and drainage. While the previously adopted regulations were all adopted by ordinance, notice was not required to be published in the newspaper, therefore not meeting the current requirement of the statute that will go into effect September 1, 2023.
No changes are proposed or have been made to the already adopted standards. The purpose of this item is to ensure compliance with the new legislation.

The City Attorney provided staff recommendations to publish the notice and readopt manuals and criteria that would be impacted by this new law.
