Authorizing the City Manager to enter into a Facility Use Agreement for the Kayak/Canoe Rental Concession at Lake Pflugerville.
Summary/Status
The 2013 rental concession agreement with the Pflug Pfun Watercraft Rentals and proprietor, Mr. Randy Martin, is being brought before Council for approval.
The Pflug Pfun Kayak/Canoe Rental Concession began operations at Lake Pflugerville on June 5, 2010. Two changes to the agreement approved last year are: opening the concession in March rather than April; and, changing the percentage of revenue the City receives from 10% to 15%.
The proposed hours of operation for the Kayak/Canoe Concession at Lake Pflugerville for the 2013 season are listed below.

Peak season is defined as Memorial Day through Labor Day.
Off season is defined as March to Memorial Day and after Labor Day through October.
 
Last year the City entered into a one year agreement with Mr. Martin with the option for two one year extensions.  This year's agreement constitutes the first one year extension. This agreement has been approved by the City Attorney, Mr. George Hyde.
 
Deadline for City Council Action
Approving this agreement at this time allows adequate time for Mr. Martin to prepare to open the business in March.
 
Fiscal Impact
Approval of this contract results in no additional cost to the City, and could net additional general fund revenue as the percentage of the revenue that the City receives has been increased. The fiscal year 2012 revenue was $1,262.28.
Staff Recommendation
Staff recommends authorizing the City to enter into a Facility Use Agreement with Mr. Randy Martin.
