Approving an ordinance on second reading with the caption reading: AN ORDINANCE OF THE CITY OF PFLUGERVILLE, TEXAS, AMENDING CHAPTER 53 OF THE CITY CODE; REGARDING THE DROUGHT CONTINGENCY PLAN; ESTABLISHING RATES FOR SURCHARGES; PROVIDING A PENALTY NOT TO EXCEED $2,000 PER OFFENSE; AND PROVIDING SEVERABILITY AND AN EFFECTIVE DATE.

Summary
The City adopted the Drought Contingency Plan by Ordinance in June 19, 1975, as required by Texas Commission on Environmental Quality (TCEQ) regulations, in accordance with regional water planning groups and compliance with Lower Colorado River Authority (LCRA) requirements. The drought contingency plan was last amended in 2005 and must be amended every five years. City staff consisting of members of the utility department's operation and administrative divisions reviewed the entire document.

A number of the changes were to improve the spelling and readability of the document in its entirety. Watering times and other regulations were made consistent throughout. Under severe drought conditions when water rationing would be necessary, the method of water allocation to residential customers was changed from a per person computation to a residential unit calculation (Section 53.210). The members of the variance review board described in Section 53.212 will be designated by the City Manager as needed. The City of Pflugerville's wholesale water customers must develop and implement a drought contingency plan using the applicable elements in this plan.

Following discussion during the City Council meeting, changes to the plan were made to specify that the plan concerns potable water only, and also specifies that the use of effluent irrigation water is not affected by the restrictions in this plan. The changes, which were all additions to the document, are highlighted on page one.
