Approving a right-of-way license and maintenance agreement with Meadowlark Community Association, Inc. related to median signage and stamped asphalt in the public right-of-way in the Meadowlark Ph. 1 and 2 Subdivision, and authorizing the City Manager to execute the same.
Summary
Meadowlark Phases 1 and 2 are constructing two phases of single-family residential housing on the east side of town along the "s" curve at Jesse Bohls Dr., east of Weiss Lane, west of Cameron Road, and north of the Carmel development. Meadowlark has an approved Development Agreement from October 2022, and a Planned Unit Development that was approved September of 2023. The project dedicated city-owned right-of-way for local streets and for a major arterial - Pflugerville Parkway. The proposed license agreement allows the owner to install stamped asphalt and subdivision entry signage within the city-owned right-of-way at the locations marked in the attached document with a requirement to maintain those improvements. These proposed enhancements are anticipated to improve the aesthetic appeal of the entry ways to the subdivision. The improvements contemplated in the license agreement were originally approved through the development agreement, but are being memorialized through a license agreement since the rights-of-way were not dedicated at the time of development agreement approval. The license agreement outlines that it will be the developer's or the succeeding homeowner/property owners' association's responsibility to install, maintain, repair, and relocation (if necessary) of the improvements.
