Title

Approving an ordinance on second reading with the caption reading: AN ORDINANCE OF THE CITY OF PFLUGERVILLE, TEXAS AUTHORIZING THE EXECUTION OF A TAX RESALE DEED FOR THE CONVEYANCE OF PROPERTY ORIGINALLY PLATTED IN 1910 AND HISTORICALLY RECOGNIZED AS LOTS 3 AND 4, BLOCK E, THE COLORED ADDITION TO PFLUGERVILLE SUBDIVISION, PFLUGERVILLE, TRAVIS COUNTY, TEXAS; PROVIDING FOR A SEVERABILITY CLAUSE; AND PROVIDING AN EFFECTIVE DATE.

 

Summary

The City recently received a notice and a Tax Resale Deed from Travis County requesting the City to execute the Tax Resale Deed.   Section 34.05 of the Tax Code allows a taxing unit to sell property it obtained under a Tax Judgment if each taxing unit entitled to receive proceeds of the sale under the Tax Judgment consents to the sale. Travis County has sold this property to JAR Tax Services, Inc. and is requesting the City to consent to the sale by authorizing the execution of the Tax Resale Deed. The City was owed $1,582.42 in ad valorem taxes from the subject tract and will be receiving $1,702.36 from the proceeds of the tax resale.  All other taxing units including Pflugerville Independent School District, Travis County, Travis County Emergency Services District #2, and Travis County Health Care District have recently approved and executed the Tax Resale Deed.

 

Legal has approved the ordinance.

 

Prior City Council Action

The ordinance was approved on first reading on May 24, 2016.

 

Fiscal Impact

The City of Pflugerville will receive the property tax payment of $1,702.36.

 

Staff Recommendation

Approve the ordinance on second and final reading.
