Summary
This agenda item requests approval of a professional services supplemental agreement (PSSA) with Freese and Nichols, Inc. in the amount of $99,897 for construction phase and post-construction phase services associated with the Central Wastewater Treatment Plant Expansion Phase I Project. This item supports the Infrastructure Pillar of the Strategic Plan.

Phase I of the Central WWTP Expansion began construction on October 19, 2019. FNI’s scope of services for the Construction Phase was originally authorized in Professional Services Supplemental Agreement No. 5 (PSSA No. 5) and was developed based on a construction duration of 24 months, with Substantial Completion scheduled for October 12, 2021. Change Order Numbers 1 through 5 between the CITY and the construction contractor extended the construction contract to a revised Substantial Completion date of April 20, 2022. FNI agreed to work through the revised April completion date under the existing fee from PSSA No. 5. Since the execution of Change Order No. 5, construction was further delayed, and FNI’s Construction Phase Services were extended to February 2023 under PSSA No. 9 and then to November 2023 under PSSA No. 12.
FNI completed a punchlist walkthrough of the site in December of 2023 and issued a letter to the Contractor on January 26, 2024, recommending that Substantial Completion not be awarded. FNI provided a punchlist with the letter that indicated construction items that need to be completed to achieve Substantial Completion and other items that need to be completed to achieve Final Completion.
