Summary
This resolution is for authorization of the City Manager to execute a Vacation, Abandonment and Release of Easement to vacate an existing water line and wastewater line easement within the Wuthrich Hill Farms development property. This existing easement (Document number 00102422) was dedicated in 1988 to the City of Pflugerville for purposes of public water and wastewater line extension through the area. The existing easement language does not meet current Public easement standards and does not well protect the interests of the City, as the easement is not exclusive and would allow other utilities and infrastructure to locate within the easement. The proposed Wuthrich Hill Farms property is pursuing vacation of this existing easement and will be dedicating a new water and wastewater easement through this area which is exclusive and wide enough to sufficiently cover the existing and proposed water and wastewater lines through this area. The proposed easement has already been reviewed and approved by legal and will be recorded with Travis County concurrently/immediately following the recordation of the vacation instrument. Approving the vacation of this existing easement and replacing it with the new proposed exclusive easements is in the City’s best interest for protection of the water and wastewater lines to be located through this area and for future operations and maintenance of these facilities.
The City Attorney has reviewed and approved the resolution and vacation instrument as to form.
