Title
Approving a Second Amendment to the Comprehensive Development Agreement between KM Kelly Lane, LTD. and the City of Pflugerville, Texas including consent to inclusion of land in a water district and the development of a 540-acre tract in Travis County, Texas and authorizing the City Manager to execute the same.
 
Summary
This agreement was originally approved in 2004. The city of Pflugerville reviews and issues building permits and performs building inspections in this area.  The intent of the proposed second amendment is to clarify expectations regarding setbacks (Section 5.1) and afford reasonable flexibility regarding the administration of the approved concept plan for the allocation and distribution of various lot types. Similar language is included in agreements for developments such as the Highland Park ALUR and the Falcon Pointe ALUR.
 
Status
The Avalon Subdivision lies within Kelly Lane WCID #1 and #2. The original consent agreement is dated August 30, 2004. A total of 1500 single-family residential lots are planned and 294 houses have been completed as of December 31, 2012, and an additional 46 lots were final platted and ready for construction.
 
Prior City Council Action
The First Amendment to the Comprehensive Development Agreement between KM Kelly Lane Ltd and the City of Pflugerville was approved in May of 2006 updating the land development plan, regulating development codes, restrictive covenant and addressed commercial property along Kelly Lane.
