Summary
The City of Pflugerville has original jurisdiction over water and wastewater rates charged by non-municipally owned utility providers. Original jurisdiction means that the City has the authority to review all information related to the rate increase and forward to the Texas Commission on Environmental Quality (TCEQ) approval or rejection of the rates. The City's decision can be appealed by the rate requester to the TCEQ, who makes the final decision.
This ordinance, along with Attachment A, defines the parameters of the City's review of the rate increase request. The information requested in Attachment A must be complete and filed with the city at least 90 days prior to any request for a rate increase. This allows the City adequate time to evaluate the information and request any additional information needed for our due diligence.
This ordinance as approved on first reading on January 22, 2013 and second reading on February 12, 2013.
The City Attorney provided slight changes to Section 3 for clarity upon the ordinance's second reading on February 12, 2013. With the amendment, the ordinance requires a third reading.
