Approving a resolution to support the legislative activities of the Alliance of Oncor Cities (AOC) during the 82nd Session of the Texas legislature as they affect electric utility ratemaking.
Summary
The City of Pflugerville is a member, along with thirty other cities, of the Alliance of Oncor Cities (AOC.) The purpose of AOC is to participate as a coalition in rate cases and certain rulemakings before the Public Utility Commission of Texas. The coalition participated in the 81st Regular Session of the Texas Legislature with opposition to legislation which would diminish the role of municipalities in the ratemaking process.
Legislation proposed in this session would effectively eliminate municipalities from any involvement in the setting of electric rates. An agenda information sheet with more detail is one of the attachments to this agenda item. The recommended resolution is also attached.
Deadline for City Council Action
In order for this action to be timely, City Council approval during this meeting is requested.
Fiscal Impact
The resolution includes a contribution of $2,000 from Pflugerville which is requested of each city in AOC over 10,000 in population (cities less than 10,000 are being asked to contribute $1,000.) This contribution will pay for lobbying efforts on our behalf by the AOC attorney, Herrera and Boyle. The payment is completely voluntary. The resolution can be passed and forwarded to AOC without a contribution to express the City's concern about the proposed legislation.
There are adequate funds in the Legal Fees category to contribute $2,000. The City Attorney is aware of this request.
Staff Recommendation
Approve the resolution to include the City of Pflugerville's concerns about the proposed legislation as a member of AOC.
