Summary
The proposed agenda item requests approval and acceptance of the special commissioners’ award along with authorization for the City Manager and City Attorney, or their designees, to take all necessary actions to finalize eminent domain proceedings for parcel 43 (located along the north line of E. Parmer Ln, west of Harris Branch Pkwy & south of E Howard Ln in Austin, Texas) for the Secondary Colorado River Raw Water Line Project.
On January 9, 2024, City Council authorized staff to initiate eminent domain proceedings after the property owner sought additional compensation that was beyond what was feasible for the City. A Commissioners Hearing was held on January 30, 2025, where it was determined that the City will compensate Austin HB Residential Properties. LTD, $180,000 for the acquisition of 1.1898 acres of land required for the project. This amount is closer to the City’s appraisal of $132,159 than to Austin HB's appraisal of $1.4 million.
Following Council approval, legal counsel will finalize the judgment documents, completing the acquisition process and securing possession of the property.
Staff continues to finalize easement acquisitions for the project, with two currently in condemnation and three parcel purchase agreements nearing completion. Acquisition of the remaining parcels is anticipated to be complete in April 2025.
