Title
Authorizing the City Manager to execute a utility relocation agreement in the amount not to exceed $211,073 between the ATMOS Energy Corporation and the City of Pflugerville for the gas main relocation associated with the Heatherwilde Road Widening Project.

Summary
As part of the Heatherwilde roadway widening project, existing ATMOS infrastructure needs to be relocated to avoid conflicts with the project.  ATMOS’ existing facilities are currently within a private easement.  Relocation of these facilities are needed for the City’s roadway project, so the City is required to pay for all associated relocation and new easement acquisition. 

This agreement specifies the requirements of the City and ATMOS respective to the utility relocation.  The City is responsible for obtaining new easements for ATMOS to accommodate the relocation and pay for all construction elements of the relocation.  Once new easements have been acquired, currently in progress, ATMOS will hire a contractor and initiate the utility relocation. At completion of the relocation, a final invoice will be sent to the City in accordance with the relocation agreement and the City will reimburse ATMOS the costs associated with the relocation.

 

The City Attorney has reviewed and approved the language of the relocation agreement.

 

Deadline for City Council Action

Staff requests approval at this time to initiate utility relocation as soon as possible.

Awarding a construction contract for the Heatherwilde Widening Project.

 

Fiscal Impact

Funds for the ATMOS Relocation are from the 2014 General Obligation Bond.  

 

Staff Recommendation

Staff recommends approval of this item for the City Manager to execute the utility relocation agreement.
