Title
Approving a resolution of a Memorandum of Understanding and associated conveyance documents between BH Pflugerville Golf, L.P. (Parcel No. 9) and the City of Pflugerville as necessary to acquire real property interest for the Kelly Lane Phase 2 Project and authorizing the City Manager to execute the same.

Summary
The Kelly Lane Phase 2 Project requires property acquisition, including the acquisition of right of way, permanent easements and drainage easements necessary to construct the project. The City’s project acquisition consultant and city staff have negotiated with BH Pflugerville Golf, L.P., for the necessary drainage easement for Parcel No. 9. The cost of $68,000 was agreed upon, subject to City Council approval, based on appraisals obtained by the City. This item supports the sustainable structure pillar of the City’s Strategic Plan.

Easement acquisitions for the Kelly Lane Phase 2 Project include a total of eleven (11) easements within parcels.

Approval of this item will authorize the City Manager to execute the drainage easement, and associated conveyance documents necessary for formal conveyance of the real property interests.

Prior City Council Action
City Council approved Professional Services with Freese & Nichols in the amount of $1,574,574 for professional engineering services associated with the 2020 Transportation Bond Program Projects on March 26, 2021.
City Council approved a Professional Services Supplemental Agreement with Freese & Nichols in the amount of $3,261,237 for professional engineering services associated with 2020 General Obligation Bond Transportation Projects on September 13, 2022.
