Title
1.)Executive Session Item: Consultation with legal counsel pursuant to Chapter 551.071 of the Texas Government Code and deliberations regarding economic development negotiations pursuant to Chapter 551.087 of the Texas Government Code regarding approving Third Amendment to the Development Agreement Regarding Bohls North and PCDC Tracts (also known as Sorento). 2.) Open Session Item: Discuss and consider action to approve a resolution approving Third Amendment to the Development Agreement Regarding Bohls North and PCDC Tracts (also known as Sorento) and authorizing the City Manager to execute the amendment.

Summary
The original Development Agreement regarding the Bohls North and PCDC Tracts was approved in 2005, with subsequent amendments in 2006 and 2009. The property was recently acquired by a new developer. The Third Amendment proposes changes to the general layout of the subdivision as reflected in Attachment 1 - Land Plan. The remaining amendments affect the Sorento Regulating Plan and are reflected in Attachment 2 of the Development Agreement.

Generally, the proposed changes to the Regulating Plan in the Third Amendment include:
· Change to the minimum lot areas, removing the requirement to allocate 5% of the lots to 9,000 sf and greater and maintaining:
- a maximum of 75% of the lots to be 6,600 sf minimum,
- a minimum of 10% for of the lots to be between 7,500-8,399 sf and
- a minimum of 10% of the lots to be a minimum of 8,400 sf.
· The front setback has been reduced from 20 to 15 feet for side loaded garage layouts only.
· Reduction in the side setbacks to allow for 5 feet standard and 10 feet at the street side.
· Modification of maximum building footprint coverage to reflect the limitations prescribed by the lot setbacks.
- Allowances for trellises to encroach 10 feet into the rear setback.
