Title
Approving an ordinance on second reading with the caption reading: An ordinance of the City of Pflugerville, Texas, repealing and replacing Chapter 92 Health and Sanitation of the code of ordinances, providing for procedures, penalties, and remedies, and providing an effective date.

Summary
The City's Health and Sanitation Ordinance, Chapter 92, was last updated in 2007. The proposed changes will provide the City with clear, modern, and legally defensible tools to address high weeds and nuisances more effectively. The proposed creates a separate Article I to address high weeds, Article II public nuisances, and article III addresses notifications and violations.The revisions align local regulations and state statutes, establishes objective standards, and create consistent procedures for notifications, enforcement, and hearings.

During Council’s consideration of this item during first reading, Council discussed and voted to pass the ordinance with an amendment. The adopted amendment added language to include the appeal process in this ordinance. The added language is as follows:
Sec. 92.14. Hearing request.
In the event that a party listed under Section 92.13 desires the hearing provided for in this Article, the party shall, within ten days of the date the notice provided pursuant to Section 92.13 is mailed or hand-delivered, present such a request in writing to the Judge of the Municipal Court. Following such appeal, the Judge shall set a date, time, and place for the hearing not earlier than the eleventh day after the date of service of the notice.
Sec. 92.15. Conduct of hearing.
When a hearing is requested pursuant to Section 92.14:
(1) Such hearing shall not be held earlier than the 11th day after the date of the service of the notice provided pursuant to Section 92.13.
