Open Session Item: Discuss and consider action to approve a Wholesale Water Supply Contract Termination Agreement between Manville Water Supply Corporation and the City of Pflugerville.

 

Summary

The City and Manville have been working to integrate and cooperate in making effective and efficient water resources available to the public in the Pflugerville area.  As part of our collective work, the parties determined that the Wholesale Water Supply Contract entered into in 2009, providing Manville with 900,000 gallons of water per day on a take-or-pay basis, was no longer necessary to serve the parties' needs. The parties are in the process of preparing and filing a CCN transfer agreement with the Public Utility Commission and in doing so, intend to replace the agreement with an on-demand wholesale water agreement to ensure water availability in periods of drought and high-peak usage.

 

This agreement has been approved as to form by the City Attorney.

 

Fiscal Impact

This agreement would terminate one agreement so that it can be replaced with another agreement.  The fiscal impact will be determined by the terms of the new agreement and will be described at that time.
