Approving payment in an amount not to exceed $330,000 to Wastewater Transport Services LLC (WWTS) for the provision of pump and haul services pursuant to the Development Agreement regarding the Meadowlark Preserve development, and authorizing the City Manager to execute the same.

Summary
On October 11, 2022 City Council approved a resolution authorizing the City Manager to execute a development agreement for the Meadowlark Preserve development.

Section 2.15 of that development agreement indicates that the City would complete the "Regional Lift Station" by June 31, 2024 and if the Developer had finished their offsite improvements but the City had not finished the lift station then the city would pay for pump and haul collection and disposal of the wastewater.

The lift station in question is the Cottonwood Lift Station.

Notice to Proceed (NTP) on that project was issued on 1/6/2025.
Original substantial completion and final completion dates were 8/18/25 and 10/13/25 respectively.
Change Order (CO) #1 revised these dates to be 10/29/25 and 12/24/25 respectively.
There has been an additional issue getting power to the site from Oncor. Staff is still working with Oncor to get a date that power will be delivered. Substantial completion will be about six weeks after Oncor is able to turn on the power.

In addition to the lift station, a force main and interceptor are needed.

The NTP for the force main and interceptor project was issued on 6/30/25.
Substantial and final completion are anticipated to be 4/26/26 and 6/25/26 respectively.

The pump and haul began in December. A PO was created to cover the past due invoices. Staff has calculated the costs of the pump and haul up to the time that the projects are complete and believe that the cost will not exceed $330,000. This amount assumes the current pump and haul rate of once per day through the remainder of February and moving to twice per day starting in March.
